§ 1 Conclusion of the Contract, Contracting Parties

  1. The accommodation contract is concluded upon the booking confirmation by the landlord in text form (e.g., by email).
  2. The booking is made by the guest placing the booking for all persons registered in the booking. The guest making the booking is jointly and severally liable for the contractual obligations of all registered persons.
  3. The accommodation may only be occupied by the persons specified in the booking. The number of persons (including children and infants) must not exceed the agreed capacity. The admission of additional persons requires the express consent of the landlord. In the event of non-compliance, the landlord is entitled to charge an additional fee of 30 EUR per night for each additional person.
  4. The transfer of the holiday apartment to third parties is not permitted without prior consent from the landlord.


§ 2 Fulfillment of the Contract

  1. The conclusion of the accommodation contract obliges both contracting parties to fulfill the contract, regardless of the duration of the stay.
  2. Unilateral amendments or additions to the contractual terms by the guest are excluded.


§ 3 Withdrawal and Cancellation

  1. The guest may withdraw from the contract at any time before the rental period begins. The effective date is the date of receipt of the withdrawal notice by the landlord.
  2. The following cancellation conditions apply in the event of withdrawal:
  • Withdrawal up to 45 days before the start of the rental: 10% of the rental price
  • Withdrawal 44 to 33 days before the start of the rental: 30% of the rental price
  • Withdrawal 32 to 22 days before the start of the rental: 60% of the rental price
  • Withdrawal 21 to 15 days before the start of the rental: 80% of the rental price
  • Withdrawal from 14 days before the start of the rental or in the event of no-show: 100% of the rental price
  1. The guest may propose a substitute tenant. The landlord’s approval in text form is required. The substitute tenant assumes all rights and obligations of the original guest. The landlord may charge a processing fee of 50 EUR for the contract transfer.
  2. For bookings made through third-party platforms (e.g., Airbnb, booking.com), the cancellation conditions agreed upon on those platforms apply exclusively.


§ 4 Consequences of Cancellation and No-Show

  1. The landlord is obligated to attempt to re-let the holiday apartment to mitigate losses.
  2. The guest is obligated to pay the agreed rental price, less any expenses saved by the landlord, for the duration of the contract if re-letting is not possible.
  3. Early departure or late arrival does not entitle the guest to a refund or reduction of the rental price.


§ 5 Check-in and Check-out

  1. The holiday apartment is available to the guest from 3:00 PM or 4:00 PM on the day of arrival (as stated in the booking confirmation).
  2. Check-out must take place no later than 10:00 AM, 11:00 AM, or 12:00 PM (according to the booking confirmation).
  3. In the event of a late check-out or delay in cleaning, the guest is liable for any resulting costs.


§ 6 Guest Duties of Care

  1. The guest agrees to treat the rental property and furnishings with care. Any damages must be reported to the landlord without delay.
  2. Furniture must not be rearranged. Rearranging furniture or unauthorized use results in an additional cleaning fee.
  3. Quiet hours (10:00 PM to 6:00 AM) must be observed. Disturbances through parties or loud music are prohibited.


§ 7 Non-Smoking Policy (Contractual Penalty and Cleaning Fee)

  1. Smoking is strictly prohibited in the holiday apartment. A contractual penalty of 1000 EUR will be imposed for any violation. Additionally, the guest bears the cost of any necessary special cleaning or repairs to eliminate smoke damage.
  2. The contractual penalty is imposed regardless of the actual cost of cleaning. The guest retains the right to prove that no damage or significantly lower damage has occurred.


§ 8 Pets

  1. Pets are only allowed with the express consent of the landlord and for an additional fee.
  2. In case of non-compliance, an additional cleaning fee of 150 EUR will be charged.


§ 9 Payment Terms

  1. Payment is made in accordance with the written agreement in the booking contract.
  2. A deposit may be required. If payment is not made on time, the landlord is entitled to cancel the booking and claim compensation for non-performance.


§ 10 Liability and Compensation

  1. The landlord is only liable for damages caused by intent or gross negligence. Liability for simple negligence is excluded, except in cases of injury to life, body, or health.
  2. The landlord assumes no liability for valuables brought by the guest.


§ 11 COVID-19 Regulations

  1. The guest is obligated to comply with all applicable COVID-19 protection measures. Entry to the accommodation is not permitted if the guest shows symptoms of illness.
  2. The landlord reserves the right to terminate the contract without notice if the guest violates applicable hygiene measures.


 § 12 Place of Jurisdiction and Final Provisions

  1. The place of jurisdiction for all disputes is Ansbach, to the extent legally permissible.
  2. Amendments and additions to these GTC must be made in text form.
  3. Should any provision of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.


§ 13 Forgotten Items

  1. Items left behind by the guest in the apartment will be returned at the guest’s request, provided they are of standard package size.
  2. A handling fee of 15 EUR per item plus shipping costs will apply.
  3. Items will only be shipped after payment is received and may take up to 21 days for delivery.
  4. If forgotten items are not requested within 6 months of departure, the landlord reserves the right to dispose of them.
